Billing & Payment Terms and Conditions

Welcome to TourneyTime.com. The following information serves as the user's notice to TourneyTime.com's billing and payment requirements.  

PLEASE SCROLL DOWN AND READ THE TERMS OF SERVICE "AGREEMENT" CAREFULLY BEFORE USING TOURNEYTIME. By using TOURNEYTIME, you signify your agreement to these terms of use and are of legal age to enter this agreement. If you do not agree to these terms of use, please do not use the Site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. Your continued use of this Site following the posting of changes to these terms will mean you accept those changes.

1. Equipment to run TourneyTime

Member shall be responsible for obtaining and maintaining all equipment, including but not limited to, all network, computer hardware and software and other any equipment needed for access to and use of TourneyTime.com.

2. Billing & Payment

TourneyTime.com, LLC uses PayPal (www.PayPal.com) and other payment processors for billing and payment transactions. Payment by the member must be received before access is granted to view, manage, and use that pool's features. All member access to that pool will be restricted until a full payment is received.The pool manager will only be billed once for the creation of the pool according to the Administrative Fee Schedule and then, if applicable, will be billed again for the pool only if it needs to be upgraded to handle additional members. However, once a payment is made for a pool, no refunds will be issued if that pools capacity level is not reached or for any other reason (see Refund Policy below). All TourneyTime members are allowed to play in pools at no additional charge as long as the paying pool member (pool manager) adheres to the TOS and terms and conditions of TourneyTime.com, LLC and the TourneyTime.com web site.The member's right to use the Service is subject to any limits established by TourneyTime or by Member's credit card issuer. If payment cannot be processed by PayPal or the member's charge is returned for any reason, including chargeback, TourneyTime reserves the right to either suspend or terminate Member's pool access and account and restrict access to all other members participating in that pool, thereby terminating this Agreement and all obligations of TourneyTime hereunder.   Member of TourneyTime is not, however, relieved of debt owed to TourneyTime.

TourneyTime takes the issue of your privacy seriously. We do not share ANY member information (registration and payment information) with anyone else. However, TourneyTime Member accounts can be transferred to another entity in the event of a merger or acquisition of the Company.

3. Refund Policy

Refunds will be given in full for valid items only as deemed by Company, including but not limited to, billing errors, registration errors, or duplicate payments.  Anyone requesting a refund under special circumstances should submit an email to support@tourneytime.com and note their TourneyTime username and reasons for cancellation to be approved for the refund.   All refunds approved by Company and due members will be paid in full within 5 days of refund approval and distributed to the PayPal account used by the canceling member or corresponding credit card.  Without limiting the foregoing, TourneyTime shall also have the right to immediately terminate Member's Account in the event of any conduct by Member which TourneyTime, in its sole discretion, considers to be unacceptable, or in the event of any breach by Member of this Agreement. This notice is located within the "Terms of Service" footer of the TourneyTime.com web site. All requests for refunds must be submitted within 10 days of the initial payment transaction.

4. Disputes

Participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with TourneyTime shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the Commercial Arbitration Rules (January, 1999) of the American Arbitration Association in Washington, D.C; (2) The participant acknowledges that the Company is an Incorporated Company and the management, directors and officers of the Company are acting on behalf of the Company, and any and all legal action related to this agreement must be brought against the company and not an officer, manager or director of the company (3) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including membership fees but in no event attorneys' fees;   and (4) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

SOME JURISDICTIONS DO NOT ALLOW THE L IMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

5. Entire Agreement

This Agreement and our Legal Disclaimer and any operating and game rules for TourneyTime constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
